North East Derbyshire District Council notes the outcome of the independent adjudication relating to the Clay Cross Town Centre regeneration project.
This adjudication relates to the contractor who left the site earlier this year.
The adjudicator’s decision is clear: no additional payment is due to the contractor.
The decision also confirms that the contractor’s attempt to terminate the contract was invalid, and that the Council’s subsequent termination was valid.
The decision confirms that:
- the contractor’s termination of the contract was invalid
- the Council’s subsequent termination of the contract was valid
- the majority of the contractor’s financial claims were not proven
The adjudicator assessed the value of the works carried out and concluded that the contractor had already been paid and as a result, no further payment was awarded.
While the adjudicator identified limited delays on some parts of the project, no additional payment was made because the contractor did not provide evidence to support claims for loss and expense.
The Council takes its responsibility to protect public money very seriously and welcomes the clarity provided by the independent adjudication.
Now that this contractual matter has been resolved, the Council will move forward with procuring a new contractor to complete the project, with further updates to follow.
